These Terms of Service ("Terms") govern your access to and use of WAWAGO, operated by CORECONCEPT SYSTEMS PTE. LTD. ("WAWAGO", "we", "us", or "our"). By accessing or using our website, products, or related services, you agree to these Terms.
1. Eligibility and Authority
You must be legally able to enter into a binding agreement to use the Services. If you use the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
2. The Services
WAWAGO provides tools for managing customer communications, including shared messaging, customer records, templates, broadcasts, catalogs, and related workflows. We may modify, improve, suspend, or discontinue any part of the Services at any time, subject to applicable law.
3. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. You must promptly notify us if you become aware of unauthorized access to or use of your account.
4. Your Data and Customer Communications
You retain responsibility for the data, content, and communications you submit to or process through the Services. You represent and warrant that you have obtained all rights, permissions, notices, and lawful bases required to collect, use, upload, and communicate with your customers and contacts through WAWAGO.
5. Acceptable Use
You must not use the Services to send unsolicited, deceptive, unlawful, abusive, infringing, or harmful communications; interfere with the operation or security of the Services; attempt unauthorized access; or violate any applicable law, regulation, or third-party right.
6. WhatsApp and Third-Party Platforms
Your use of integrations and third-party platforms, including WhatsApp and Meta services, is subject to their applicable terms, policies, approvals, and technical requirements. You are solely responsible for complying with those requirements, including messaging, opt-in, template, and commerce rules. We do not control and are not responsible for third-party platforms or their availability, actions, or changes.
7. Open-Source and Self-Hosted Use
Portions of WAWAGO may be available under an open-source license. Your use of open-source software is governed by the applicable license terms. When you self-host WAWAGO, you are responsible for your deployment, infrastructure, security controls, data management, backups, and legal compliance.
8. Intellectual Property
Except for your data and rights granted under applicable open-source licenses, WAWAGO and its licensors retain all rights, title, and interest in the Services, including associated software, trademarks, designs, and documentation. These Terms do not grant you any rights except those expressly stated.
9. Fees and Payments
Where a paid service is offered, the applicable fees, payment terms, and taxes will be presented to you before purchase or otherwise agreed in writing. Unless required by law or expressly stated otherwise, fees are non-refundable.
10. Suspension and Termination
We may suspend or terminate access to the Services if we reasonably believe that you have violated these Terms, created a security risk, exposed us or others to legal liability, or misused the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.
11. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
12. Limitation of Liability
To the fullest extent permitted by law, WAWAGO and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business opportunity arising from or related to the Services. Our aggregate liability for all claims arising from or related to the Services will not exceed the amount you paid us for the Services in the twelve months preceding the event giving rise to the claim.
13. Indemnity
You will defend, indemnify, and hold harmless WAWAGO and its affiliates, officers, employees, agents, and licensors from and against claims, liabilities, damages, losses, and expenses arising from your use of the Services, your data or communications, or your violation of these Terms, applicable law, or third-party rights.
14. Governing Law
These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. The courts of Singapore will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, except where applicable law requires otherwise.
15. Changes to These Terms
We may update these Terms from time to time to reflect legal, technical, or business changes. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
